1) About These Terms
These Terms & Conditions (“Terms”) govern your access to and use of thenaip.org and any related content, events, memberships, donations, or services (collectively, the “Services”). 2) Eligibility & Accounts

4) Content & Intellectual Property
Our Content. The Services and all content, trademarks, and logos (“NAIP Content”) are owned by us or our licensors and protected by law. We grant you a limited, revocable, non-transferable license to access and use NAIP Content for your personal or authorized organizational use, subject to these Terms. No resale or redistribution without our written permission.
Your Submissions/UGC. You keep ownership of content you submit (posts, comments, materials). You grant NAIP a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute your content to operate and improve the Services. You promise you have the rights to submit it and it doesn’t infringe others’ rights.
Feedback. Suggestions are voluntary; we may use them without obligation.
5) Cancellations, Refunds & Changes
Cancel anytime: [email protected]. Cancellation takes effect at the end of the current billing period unless stated otherwise.

6) Acceptable Use & Community Standards
You agree not to: violate laws; harass or discriminate; post unlawful, infringing, or harmful content; scrape, crawl, or reverse engineer; interfere with security; or misrepresent your identity or affiliation. We may moderate, remove content, or suspend access for violations.
7) Events & Recordings

10) Disclaimers
The Services and all content are provided “AS IS” and “AS AVAILABLE.” We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage. We do not warrant uninterrupted or error-free operation or that information is accurate or current.
11) Limitation of Liability
To the maximum extent allowed by law: (a) NAIP is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, revenues, data, or goodwill; and (b) our total liability for any claim will not exceed the amounts you paid to NAIP in the 12 months before the claim (or $100 if you have not paid). Some jurisdictions do not allow certain limits; some rights may not be waived.
12) Indemnification
You agree to defend, indemnify, and hold harmless NAIP and its officers, directors, employees, and agents from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your content, your use of the Services, or your violation of these Terms or law.
13) Suspension & Termination
We may suspend or terminate your access if we believe you violated these Terms, pose a risk, or if required by law. Upon termination, your license ends and you must stop using the Services. Sections that reasonably should survive (IP, payments due, disclaimers, limits, indemnities, dispute resolution) survive.
14) Dispute Resolution; Governing Law
These Terms are governed by Pennsylvania law. Exclusive jurisdiction and venue lie in the state and federal courts located in Erie County, Pennsylvania.
15) Electronic Communications & Notices
You agree to receive service-related communications electronically (email, in-product notices). Marketing emails are optional and may be unsubscribed anytime.
16) Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control (e.g., Internet or hosting outages, labor disputes, epidemics, governmental actions, natural disasters).
17) Assignment
You may not assign these Terms without our prior written consent. We may assign in connection with a merger, acquisition, or asset transfer.
18) Entire Agreement; Severability; Waiver
These Terms (plus plan-specific terms and our Privacy Policy) are the entire agreement between you and NAIP regarding the Services. If any provision is unenforceable, the remainder remains in effect. A failure to enforce is not a waiver.
